At least four telecommunications industry associations have asked a federal appeals court to reverse its earlier decision upholding the Federal Communications Commissions new net neutrality rules.
The U.S. Court of Appeals for D.C. ruled 2-1 in favor of upholding the FCC rules in June. Among other provisions, the new rules prevent Internet service providers from slowing down traffic speeds to certain websites and online services.
CTIA is among the trade groups that asked the appeals court Friday to reconsider its decision, Reuters news agency reported. USTelecom, the National Cable & Telecommunications Association and American Cable Association have also requested a rehearing, as has AT&T.
The trade groups said their motion that the court should correct "serious errors" that "radically reshapes federal law governing a massive sector of the economy, which flourished due to hundreds of billions of dollars of investment made in reliance on the policy the order throws overboard." http://reut.rs/2aqbeu0
In a statement, FCC Chairman Tom Wheeler urged the court to reject the industry's attempt to rehear the case. Wheeler, the former CEO of NCTA, said, "It comes as no surprise that the big dogs have challenged the three-judge panel's decision."
"We are confident that the full court will agree with the panel's affirmation of the FCC's clear authority to enact its strong Open Internet rules, the reasoned decision-making upon which they are based, and the adequacy of the record from which they were developed," he said. http://fcc.us/2acuaho
